Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of CouchCode, including our website, software, apps, daemon, relay, APIs, documentation, beta features, and related services.

By accessing or using CouchCode, you agree to these Terms. If you do not agree, do not use CouchCode.

1. The Service

CouchCode is a tool for remotely interacting with coding agents, development tools, terminals, approval prompts, sessions, and related workflows.

The service may include local software, mobile apps, relay infrastructure, hosted services, beta features, experimental features, and integrations with third-party tools.

CouchCode is evolving. Features may change, break, be limited, or be removed.

2. Eligibility

You may use CouchCode only if you can legally agree to these Terms and use the service under applicable law.

If you use CouchCode on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and Security

You are responsible for your account, devices, credentials, access tokens, pairing codes, and any activity under your account.

You agree to:

  • Provide accurate information where required
  • Keep your credentials secure
  • Protect devices connected to CouchCode
  • Notify us promptly of unauthorized access or security issues
  • Use reasonable care when approving actions, commands, file changes, or agent requests

We are not responsible for losses caused by your failure to secure your account, device, environment, credentials, or development tools.

4. Your Use of CouchCode

You agree not to use CouchCode to:

  • Break the law
  • Access systems, accounts, files, or data without authorization
  • Interfere with or disrupt the service
  • Abuse relay infrastructure or attempt to overload systems
  • Reverse engineer hosted components except where allowed by law
  • Circumvent rate limits, security controls, authentication, or access restrictions
  • Upload or transmit malware or harmful code
  • Use CouchCode in a way that harms other users, third parties, or our infrastructure

We may suspend or terminate access if we believe your use creates risk, violates these Terms, or may harm the service or others.

5. Your Content and Development Environment

You are responsible for the code, files, prompts, terminal commands, agent actions, outputs, approvals, repositories, credentials, secrets, and environments you connect to or control through CouchCode.

CouchCode may transmit, route, display, or process information necessary to provide product functionality.

You retain ownership of your code and content. These Terms do not transfer ownership of your code to us.

You grant us the limited rights necessary to operate, secure, debug, and improve the service.

6. Agent Actions and Approvals

CouchCode may allow you to approve, reject, forward, inspect, or interact with requests from coding agents or development tools.

You are responsible for reviewing actions before approval. Agents may make mistakes. Tools may behave unexpectedly. Commands may modify files, delete data, expose secrets, create costs, or break things in ways that are traditional for software.

You agree that you are responsible for the consequences of actions you approve or initiate through CouchCode.

7. Third-Party Services and Integrations

CouchCode may integrate with third-party tools, agents, APIs, repositories, cloud providers, authentication providers, payment processors, app stores, or other services.

We are not responsible for third-party services, their availability, security, behavior, terms, or data practices.

Your use of third-party services may be governed by their own terms and policies.

8. Beta and Experimental Features

CouchCode may include beta, preview, experimental, or pre-release features.

These features may be incomplete, unstable, limited, changed, removed, or unavailable at any time. Use them at your own risk.

We may collect feedback and usage information to improve these features.

9. Payments and Subscriptions

If paid features are offered, pricing, billing intervals, limits, refunds, trials, and cancellation terms will be described at checkout or in the applicable plan details.

Unless otherwise stated, fees are non-refundable except where required by law.

We may change pricing or plan features in the future. If required, we will provide notice before changes apply.

10. Availability and Changes

We try to keep CouchCode available and reliable, but we do not guarantee uninterrupted or error-free operation.

We may modify, suspend, limit, or discontinue any part of the service at any time.

We may impose usage limits, rate limits, storage limits, connection limits, or other restrictions to protect the service, control costs, or prevent abuse.

11. Open Source Components

CouchCode may include or interact with open-source software. Open-source components are governed by their applicable licenses.

Where required, notices or license information may be provided in documentation, repositories, app packages, or related materials.

12. Intellectual Property

CouchCode, including our name, branding, website, hosted service, software, designs, documentation, and related materials, is owned by us or our licensors, except for content owned by users or third parties.

You may not use our branding, logos, or trademarks without permission, except as allowed by law.

13. Feedback

If you provide feedback, suggestions, ideas, bug reports, or improvements, you grant us permission to use them without restriction or compensation.

This does not give us ownership of your underlying code or private project content.

14. Disclaimers

CouchCode is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, reliability, and security.

We do not guarantee that CouchCode will be uninterrupted, secure, error-free, or suitable for your specific use case.

15. Limitation of Liability

To the maximum extent permitted by law, CouchCode and its owners, operators, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost code, business interruption, security incidents, or development errors.

To the maximum extent permitted by law, our total liability for any claim related to CouchCode will be limited to the amount you paid us for the service during the twelve months before the claim, or one hundred US dollars, whichever is greater.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless CouchCode and its owners, operators, affiliates, employees, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from your use of the service, your content, your development environment, your approved actions, your violation of these Terms, or your violation of law or third-party rights.

17. Termination

You may stop using CouchCode at any time.

We may suspend or terminate your access if we believe you violated these Terms, created risk, caused harm, failed to pay fees, or used the service in a way that may harm us, users, infrastructure, or third parties.

After termination, some provisions will continue to apply, including those related to ownership, disclaimers, limitations of liability, indemnification, and dispute resolution.

18. Governing Law

These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules.

Any disputes will be resolved in the competent courts located in Tallinn, Estonia, unless applicable law requires otherwise.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above.

If changes are material, we may provide additional notice where appropriate. Continued use of CouchCode after changes become effective means you accept the updated Terms.
